Copy of an Indenture declaring a Trust of a Chapel called Bethesda
Dated: 31st August 1803

Of note are ... the establishment of Bethesda Chapel as part of the Methodist New Connexion, the rules for trustees, the names and signatures of many local pottery owners who were very involved in Methodism.

The Indenture made the Thirty first day of August in the Year of our Lord One thousand eight hundred and three Between Job Ridgway of Shelton in the Parish of Stoke-upon-Trent in the County of Stafford, Potter, of the one part and George Ridgway, Joseph Boon, Richard Hicks and William Hackney all of Shelton aforesaid, potters; Job Mee, Richard Thurfield and Joshua Mayor all of Hanley in the parish and County aforesaid, potters; John Mort and Jesse Barker both of Burslem in the said County, potters; Daniel Shufflebotham of Shelton aforesaid, Draper; Thomas Allbutt of Hanley aforesaid, Stationer; John Swinnerton of the same, plate cratemaker; Charles Chester of Newcastle under Lyme, Stationer; George Barnes of the same place, Draper; William Bailey of lane End in the same County, Guilder of Earthenware and Joseph Booth of the same place, potter (being respectively Members of a Religious Society known by the name of the new connection of Methodists or persons previously professing the same religious opinions) of the other part.

Whereas the said Job Ridgway lately purchased of and from Amey Hammersley of Shelton aforesaid, Widow; Charles Bagnall of the same place, Gentleman and William Tittounor (?) of Hanley aforesaid, Gentleman (since deceased). Three several plots or parcels of Ground adjoining together situate and being in Shelton aforesaid and the same have been duly surrendered to the said Job Ridgway his Heirs, and  Assigns for ever. And Whereas the said Ground was so purchased for the purpose of erecting a Chapel or Meeting House thereon for the public worship of Almighty God in the manner hereinafter mentioned and for a Burial Place to the same. And whereas such Chapel of Meeting House hath been since accordingly erected thereon and is called or known by the name of Bethesda and it is expedient that the Trusts upon which the said Ground and Chapel are holden should be publickly manifested and declared.

Now this Indenture Witnesseth that all the said several persons, parties hereto do hereby Testify and Declare that the said Ground was so purchased by the said job Ridgway and the said Chapel was erected thereon Upon Trust and Confidence that the said Chapel might be used by the said Job Ridgway, George Ridgway, Joseph Boon, Richard Hicks, Thomas Albutt, John Swinnerton, Charles Chester, George Barnes, John Mort, Jesse Barker, Daniel Shufflebotham, William bailey, Joseph Booth, William Hackney, Job Mee, Richard Thurfield and Joshua Mayor and such other members of the said religious Society called or known by the name of the New Connection of Methodists as shall from time to time be united with the said parties to these presents and by any other persons willing to attend Divine Service there and who shall behave reverently and devoutly therein as and for a place for the public worship of Almighty God for ever hereafter unless three parts in four of the full number as aforesaid of [text in italics added in pencil on document] Trustees for the time being in whom the said Chapel Ground and Premises shall be vested shall judge it expedient to discontinue the celebration of Divine Worship therein and to sell and dispose thereof as hereinafter is mentioned. And Upon Trust and Confidence that they the said Job Ridgway, George Ridgway, Joseph Boon, Richard Hicks, William Hackney, Job Mee, Richard Thurfield and Joshua Mayor, John Mort, Jesse Barker, Daniel Shufflebotham, Thomas Albutt, John Swinnerton, Charles Chester, George Barnes, William Bailey and Joseph Booth their Heirs and Assigns shall and do permit and suffer a Dwelling House in case the same shall be built near to the said Chapel and the Cellars under the said Chapel to be used, occupied and enjoyed in such manner and by such person or persons as they that said Trustees their Heirs or Assigns or the major part of them for the time being shall from time to time direct and approve of.

And the said several parties hereto Do by this their Deed in Writing further Testify and Declare that all Rents and Monies which shall arise from time to time and come into the hands of the said Trustees, their Heirs or Assigns from the said Chapel or the Pews or Seats therein or the Cellars under the same or f any House to be built or from the Voluntary Contribution of the members of the said Religious Society or any person or persons contributing to the support and welfare of the said Chapel shall be applied and disposed of by the Trustees for the time being according to the order and directions to be from time to time made respecting the application and disposal thereof by them the said parties hereto or the major part of them or the Trustees and owners of the said Chapel for the time being and which shall be entered in the said Book or Register belonging to the said  Chapel and that the payments of principal monies borrowed or to be borrowed for the purposes of the said Chapel and the Interest thereof and all other payments and disbursements for or on account of the said Chapel and premises and all other acts maters and things relating thereto shall be regulated ordered made sad done according to the resolution to be from time to time entered in the said Book or Register belonging o the said Chapel and which shall be signed by the said Trustees or the major part of them or by the Trustees of the said Chapel for the time being. 

Provided always and it is hereby agreed that if any of them the said parties hereto or any future Trustee shall become Bankrupt or shall on account of Insolvency  assign over his estate and effects or shall go to reside at any place at the distance of Twenty miles or upwards from Shelton or shall be desirous to resign his Trust or shall otherwise according to any Rule or Order to be entered in the said Book of Rules and orders become disqualified for continuing to be a Trustee then and in every such case he shall thereupon cease to be a Trustee and shall then immediately upon the request and at the costs of the other Trustees for the time being or the major part of them convey all the Right Title Estate and Interest of and in the said Chapel Land and Premises unto the other Trustees for the time being their Heirs and Assigns or as they shall direct or appoint. 

Provided also and it is hereby Declared and agreed by and between all and every the said parties hereto that when the number of them shall at any time by Death or any of the other causes above mentioned be reduced to seven such of them the said Trustees as shall be then surviving or remaining or the major part of them shall forthwith nominate and appoint such and so many orderly and devout persons being of the said religious society call the new connection of Methodists or frequenters of Divine Service in some of the said Chapels of the said new connection to be Trustees in the room and stead of those who have ceased to be Trustees and with them surviving or remaining Trustees shall make up the full number of Seventeen Trustees and that such surviving or remaining Trustees shall and will immediately by good and sufficient conveyances  and assurances in the Law well and effectually vest the said Chapel Trust Estate and premises in such new Trustees to be nominated as aforesaid and the surviving or remaining Trustees jointly their Heirs and Assigns for ever but upon the Trusts and for the purposes herein and hereby Declared and that the like cause shall afterwards be observed from time to time whenever the number of Trustees for the time being of the said Chapel shall by Death or any other of the causes aforesaid be again reduced to the number of seven Trustees in order the better to carry into effect the Trusts and purposes of those presents and upon every such appointment of new Trustees such new Trustees together with the old surviving Trustees shall execute a Declaration of Trust similar to what is herein contained. 

And it is hereby provided Declared and agreed by and among all the said parties hereto that it shall and may be lawful to and for the Trustees for the time being and they are hereby required at any time or times whenever three parts in four in number of them shall deem it expedient to demise grant release or convey by way of mortgage the said Chapel Ground and premises or any part thereof unto any person or persons for the security of any sum or sums of Money advanced and lent or to be advanced and lent to the said parties hereto or the Trustees for the time being for the building rebuilding repairing enlarging amending or altering the said Chapel or Buildings or otherwise in or about the premises or absolutely to sell and dispose of the said Chapel Ground and premises either together or in parcel by public auction or private Contract unto any person or persons who may be willing to purchase the same for such price or prices as can be reasonably obtained and to grant release and convey the Fee simple and Inheritance thereof or of any part thereof unto such purchaser or purchasers his heir or their Heirs and Assigns for ever or otherwise as such purchaser or purchasers shall direct or appoint. 

And it is hereby further Declared and agreed that the money to be raised by such Sale or Sales shall be applied in paying off and discharging all Debts and sums of money owing or to be owing by the said Trustees or any succeeding Trustee or Trustees for or on account of the said Chapel or premises or in case there shall be any surplus such surplus shall be applied in purchasing or building some other Chapel or in some other religious or charitable purpose as three parts in four of the Trustees and Owners for the time being shall direct or appoint but if three parts in four of the Trustees shall not agree in the application of such surplus then the same shall be applied according to the directions to be entered in the said book to be provided for registering the rules and regulations of the said Chapel. 

And it is hereby further declared and agreed by and among all the said parties hereto that the receipt and receipts of them or of the Trustees for the time being under their hands for such purchase Money or Mortgage Money shall be a good and sufficient discharge to any purchaser or purchasers Mortgagee or Mortgagees after such receipt or receipts shall be given shall not be obliged to see to the application of such purchase Money or Mortgage Money nor be in any wise answerable or accountable for any loss, misapplication or nonapplication thereof or of any part thereof but shall and may have hold and enjoy the said promises To the sole use and benefit of him her or them and his her or their Heirs, Executors or Administrators according to the nature of such Conveyance or assurance to be made thereof as aforesaid any Declaration Trust clause Matter or thing hereinbefore contained to the contrary notwithstanding. 

And Lastly it is hereby Declared that the said Chapel and premises and the Concerns thereof shall in all respects be managed and regulated according to the Regulations, Rules and Orders contained or to be contained in the said Register or Book of Orders to be kept in and for the said Chapel provided the rules to be made are not contrary to and do not militate against the Trusts and purposes hereby declared.
